General terms and conditions of trade By registering yourself as user on HellenicSpace, you are accepting the following general terms and conditions of trade (called "GTCT" in the following). Contractual partner is alpha cross network ltd., Talstrasse 13, 86316 Friedberg, Germany, called "HellenicSpace" in the following. HellenicSpace is a project of alpha cross network ltd. The GTCT refer to the following websites: www.hellenicspace.com, www.hellenicspace.net and www.hellenicspace.de as well as to all associated sub domains and aliases.
These GTCT define the basic rules for the use of the website, they contain rules in respect of data security including the consent to data storage and are also valid if other websites, which enable the entire or fractional access to HellenicSpace, are used. The GTCT, which are valid at the time of application for membership do apply.
This offer is for people using the website for private purposes only. HellenicSpace dissociates at the same time from contents of user profiles.
1. Object
1.1. HellenicSpace provides a platform to registered users (called "user" in the following): a closed contact platform for exchange of information of private contact details.
1.2 Any use beyond the provided possibilities by the HellenicSpace websites, must be approved by HellenicSpace in written form first.
1.3 HellenicSpace merely offers information provided by the user, as long as the information do not violate legal requirements or these GTCT. HellenicSpace is authorised to remove from the website illegal contents without prior notice.
1.4 HellenicSpace reserves the right to modify, to widen, to shorten or to stop the platforms in respect of content, setup and scope. The user accepts that in general a 100% availability cannot be guaranteed technically speaking. HellenicSpace reserves the right to stop or narrow the service for maintenance, security or capacity reasons.
1.5 At any time, HellenicSpace has the right to lock users, or to attach certain conditions to the use. This or their limitation will be considered in particular if a user offends against current rights or against this GTCT, if HellenicSpace has a justified interest in blocking, especially if the user has provided or maintains misstatements in his data, if the user violates rights of other people, abuses goods and services of HellenicSpace or if there is another important reason. Justified interests of the user will be taken into account in conjunction with a blocking.
1.6 HellenicSpace is not involved directly and will be contractual partner in no case in connection with communication or possible deals of the users. Also the performance of a contract is up to the users solely. HellenicSpace is merely offering a platform to bring together users and is only supplying the gimmick allowing in general contacting between users. HellenicSpace is not liable if no contact comes about in connection with a contract between users. Neither is HellenicSpace liable for neglects of duty of the users in respect of contracts concluded between the users.
1.7 The user can register himself only through the websites operated by HellenicSpace. Along with the registration, a user contract between user and HellenicSpace materialises on basis of this GTCT, unless Hellenicspace does not refuse the registration immediately. The user ensures that all given information is correct and complete. The user is beholden to correct amendments of user data immediately. No right to registration exists. HellenicSpace reserves the right to recall the licence at any time and without notice, especially if wrong information is given when registering and if the platform is misused.
1.8 When registering the user chooses a password. He is obliged to conceal his password. HellenicSpace will not pass on the password to any third party and will not at all ask the user about the password.
1.9. The user knows that the HellenicSpace database is not only available on the domain www.hellenicspace.com, but also as additional offer on the websites of our co-operation partners, who complete their own online appearance with the HellenicSpace website within the scope of collaboration.
1.10. It is difficult to authenticate Internet users. HellenicSpace does not warrant that every user is really the person he / she pretends to be. Every user has to assure himself / herself of the identity of the other user if necessary.
2. Users\' Obligations
The users are beholden to:
2.1 To give only true particulars in their profiles and in their communication with other users;
2.2 To make sure that the public communication of their photos and videos, forwarded or placed on the website by them is allowed and do not infringe any copyrights;
2.3 Also not to publish any else contents that are against the law or that offend the rights of a third party;
2.4 In particular the user is strictly prohibited,
2.4.1 To use offensive or defamatory contents, independent of who is concerned by those contents, pornographic contents or contents offending against the protection of minors, or to solicit, offer or to distribute contents offending against the protection of minors;
2.4.2 To use contents that are securded by law (e. g. by copy right, trademark law, patent law, design protection law or utility model law), in particular photos, videos and pieces of music, without being authorized, or to solicit, offer or distribute goods that are protected by law.
2.4.3 To threaten or to bother unacceptably other users, in particular by spam according to — § 7 UWG.
2.4.4 To do anticompetitive acts or assist them, including progressive canvassing (e. g. chainletter system or pyramid sales);
2.4.5 To send chain letters or identical enquiries to several users at the same time.
2.4.6 To use offensive, insinuating or sexually stamped communication (explicitly or implicitly)
2.4.7 It is strictly forbidden to use mechanisms, software or miscellaneous scripts in conjunction with the use of the HellenicSpace website and to block, to overwrite, to modify or to copy (this also applies to copying in the way of "Robot / Crawler" — search engines or other automatic mechanisms) or to bandy generated contents. The user has to avoid an unreasonable or excessive charge of the HellenicSpace infrastructure.
2.4.8 To upload or transmit programmes and files that contain a virus, a Trojan or other malware, which is able to damage, to restrict or to destruct the serviceability of any software, hardware or other accommodations of telecommunication. The user has to avoid an unreasonable or excessive charge of the HellenicSpace infrastructure.
2.4.9 To use or publicize contents of any kind, which appeal for a criminal act iSd § 11 Abs. I nr. 5 St GB, which boost or even demonstrate such acts, which infringe rights of third parties, or which also lead to a liability or another contravention.
2.5. The users by themselves are all-out responsible for the information they are publishing on HellenicSpace, like for photos, information in the user profile, messages, music, videos, publicity or for any other published contents by the user. It is left to HellenicSpace´ s discretion, to erase contents without prior notice if HellenicSpace only estimates that the content which is to be erased has been published in breach of above mentioned conditions, or shows to be displeasing or illegal or infringes rights of third parties.
2.6. At any rate are the users solely responsible for the interactions with other users and for their behaviour towards other users, either inside or outside the HellenicSpace website, and HellenicSpace is therefore in no case liable. HellenicSpace reserves the right, without being bound to, to monitor quarrels between users on the website, and to take administrative action according to these GTCT.
3. Termination of the agreement
At any time both parties have the right to terminate the agreement with immediate effect. The user must send the notice of termination by email to mail@HellenicSpace.com. If the user wishes, all personal data will be deleted by HellenicSpace after termination. HellenicSpace communicates a termination of agreement in written by email. The interests of the user will be considered in the case of a termination.
4. Liability
4.1. HellenicSpace does not warrant for any information or statements given by their users. HellenicSpace does not assume liability for any neglect of duty of a user vis-á-vis another user on the basis of contracts concluded between them. In no case does HellenicSpace assume any liability for users in respect of direct or indirect damage or disadvantages which result from the use of the HellenicSpace service.
4.2 HellenicSpace will assume liability towards the user only for damages that a legal representative or assistant has caused intended or grossly negligent, however, in no case for damages that are outside of the subject matter of contract (consequential damages), no matter of which legal ground. When acting simply negligent, we will be merely liable for damages caused by infringement of life, body and health or by infringement of an essential contractual obligation / cardinal obligation. In the latter case of a simply negligent breach of duty by HellenicSpace or their assistants the liability is limited to the foreseeable loss and to the loss typical for this type of contract.
4.3. Furthermore, pretensions of warranty and indemnity in respect of positive breach of duty according to § 280 BGB, also in respect of objects of legal protection of third parties and escaped benefits are excluded, as far as these pretensions do not base on a deliberate or grossly negligent behaviour of HellenicSpace, their legal representatives or assistants.
4.4 It is up to the user himself, to protect his data, to shelter and to keep free from vermins his network connection and his already available soft- and hardware. Liability for loss of data by viruses, worms, trojans, etc. is excluded. The user is expressly advised of the possibility of loss of data due to technical malfunction and the need of daily backup resulting from this. Forbearance of daily backup when working important data is a grossly negligent action of the customer himself, so that HellenicSpace is not liable for it. Liability for loss of data caused by grossly negligent or deliberate action of HellenicSpace is limited to the rebuilding efforts if backup copies are existent. Should the user not be able to furnish a backup copy needed for the rebuilding of the data, HellenicSpace is completely released from liability.
4.5. The user exempts HellenicSpace from demands claimed by other users or other third parties toward HellenicSpace insofar if those demands base on a culpable offence of the user against subparagraph 2.1 of these GTCT; The obligation to exempt from a duty also covers the appropriate costs for the necessary advocacy.
5. Data security
5.1. HellenicSpace advises the users that HellenicSpace handles the details given by the user in machine readable form automatically as well as for purposes that result from the contractual relationship. Passing on data to third parties is carried out within the contractual purpose only. HellenicSpace stresses emphatically that all data protection regulations are strictly considered, especially as to dissemination of data to third parties.
5.2 HellenicSpace offers to all users the opportunity to communicate parts of or complete contact data or to countermand the access to the data. The forwarding of these contact data happens at users own risk.
5.3 Upon agreement of these GTCT the user declares at the same time:
I agree,
a. that HellenicSpace collects my personal data, handles and uses them to justify, to carry out and to winding up my contractual relationship with HellenicSpace. Personal data are inventory data, as e. g. name and address, as well as user figures like e. g. user name, password and IP address.
b. that HellenicSpace provides other users with diverse data self-entered by the user. At registration the user will know which data will be allocated. The provision of data can be changed at any time by choosing "my account - settings".
c. that HellenicSpace collects, carries out and avails of my user data with cookies among other things, e. g. in order to connect me to a user ID. Cookies serve e.g. as a personal address of welcome with the username on HellenicSpace.
d. that HellenicSpace works with and uses my personal data to showcase contacts to me that are according to my personal interests. I have the possibility to disagree with the use of specific personal interests by choosing "my account - settings".
e. that HellenicSpace, if required in individual cases, is allowed to collect and use the inventory and user data according to the presentation of real clues that are to be documented, if fraudulently information and other illegal or contrary to contract usage of the service of HellenicSpace can be detected or eliminated. For this purpose HellenicSpace is also permitted to collect, work and use - inter alia by utilizing cookies - user figures, in order to be able to determine out of the total those pieces of information that indicate real reference points that they have been set with intention of abuse.
f. that, in addition and if required HellenicSpace is allowed to work, use and pass on my personal data to law enforcement agencies as well as to third parties whose rights have been harmed in order to keep predominant interests in clearing up a misuse of the HellenicSpace market or to litigate beyond the relationship with HellenicSpace, if there are real clues for such a misuse of the HellenicSpace platform, especially when setting illegal offers
g. and I admit, that a utilization of the platform is not acceptable when using aliases or being anonymous, and that the aim of this platform could thus not be achieved. Nevertheless I want to become a user.
This acceptance is saved on every site of the HellenicSpace website in the link GTCT and can be revoked at any time in written by sending an email to mail@hellenicspace.com stating the username and password.
6. Final Clause
6.1. There are no verbal side-agreements. Changes of any kind must be in written form.
6.2 HellenicSpace reserves the right, to amend these GTCT at any time and without nomination of any reasons, unless this is not reasonable to the customer. The changed conditions will be sent to the user by email two weeks before coming into effect at the latest. If the user does not veto the validity of the new GTCT within two weeks after receipt of the email, the amended GTCT are classified as accepted. In the email including the altered conditions HellenicSpace will inform the user separately about the relevance of this time limit.
6.3 HellenicSpace is allowed to confer completely or partly the rights and duties of this contract upon a third party. This has to be announced by email 4 weeks in advance. In this case, the user has the right to withdraw from this contract by email to mail@hellenicspace.com after notice of this transfer.
6.4 All explanatory notes, which are transmitted within the framework of the user contract concluded with HellenicSpace, have to be sent in written or per email. This email address of HellenicSpace is mail@hellenicspace.com. The postal address as well as the email address of a user is the one stated in his user account as current contact data. HellenicSpace reserves the right to change the above mentioned own email address at its own discretion. In this case HellenicSpace will inform the user about the alteration of the email address.
6.5. Place of fulfilment is the domicile of HellenicSpace. Sole place of jurisdiction for all disputes between the parties arising out of the contractual relationship is - see Impressum. Only German law decides on the contractual relationship excluding the Convention on the international Sale of Goods and the international civil law.
